1. Agreement Overview

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "Renter," or "you") and Justice SecretWise Inc. ("Company," "we," "our," or "us") regarding your use of our luxury vehicle rental services. By renting a vehicle from us or using our services, you agree to be bound by these Terms.

3.1 Age Requirements

• Primary renter must be at least 25 years of age
• Additional drivers between 21-24 subject to young driver surcharge
• Drivers under 21 are not permitted

3.2 License Requirements

• Valid driver's license held for minimum 2 years
• International Driving Permit required for non-Canadian licenses
• Clean driving record with no major violations in past 3 years
• No license suspensions or revocations in past 5 years

3.3 Financial Requirements

• Valid major credit card in renter's name
• Sufficient credit limit for rental charges and security deposit
• Debit cards accepted only with additional verification

4. Reservation and Booking

4.1 Reservation Process

Reservations can be made through our website, mobile app, or by phone. All reservations are subject to vehicle availability and confirmation by our team.

4.2 Booking Confirmation

A reservation is confirmed only upon receipt of our written confirmation via email. We reserve the right to decline any reservation at our discretion.

4.3 Advance Booking Requirements

• Minimum 24 hours advance booking for standard reservations
• Minimum 72 hours for specialty or high-end vehicles
• Same-day bookings subject to availability and additional fees

5. Rental Rates and Payments

5.1 Rental Rates

Rental rates vary by vehicle class, rental duration, season, and demand. All rates are quoted in Canadian dollars and include applicable taxes unless otherwise specified.

5.2 Payment Terms

• Payment due at time of vehicle pickup
• Security deposit required on credit card
• Additional charges processed within 72 hours of return
• Late payment fees apply to overdue balances

5.3 Additional Fees

Additional fees may apply for:

• Additional drivers ($25/day per driver)
• Young driver surcharge (ages 21-24: $35/day)
• One-way rentals (varies by distance)
• Airport pickup/delivery ($75-150 depending on location)
• After-hours pickup/return ($100)
• GPS navigation ($15/day)
• Child safety seats ($10/day)
• Winter tire package ($20/day, Nov-Apr)

6. Vehicle Pickup and Return

6.1 Pickup Requirements

At pickup, you must present:

• Valid driver's license
• Major credit card in your name
• Reservation confirmation
• Additional identification if requested

6.2 Vehicle Inspection

You must inspect the vehicle before accepting it and report any damage, defects, or concerns. Failure to report existing damage may result in charges upon return.

6.3 Return Conditions

• Vehicle must be returned to the agreed location
• Return by agreed date and time
• Same fuel level as at pickup (unless prepaid fuel selected)
• Clean interior condition
• All provided accessories and documentation

7. Vehicle Use Restrictions

7.1 Permitted Use

Vehicles may only be used for legal purposes on paved public roads within Canada and the United States (with prior approval).

7.2 Prohibited Activities

The following activities are strictly prohibited:

• Off-road driving or racing
• Commercial use (ride-sharing, delivery, etc.)
• Smoking or vaping in the vehicle
• Transportation of illegal substances
• Exceeding vehicle capacity limits
• Towing other vehicles or trailers
• Driving under the influence of alcohol or drugs
• Allowing unauthorized drivers to operate the vehicle

7.3 Geographic Restrictions

• Travel to Mexico strictly prohibited
• US travel requires advance approval and additional insurance
• Remote areas may require GPS tracking device

8. Insurance and Liability

8.1 Basic Coverage

All rentals include basic liability insurance as required by Canadian law. Additional coverage options are available:

• Collision Damage Waiver (CDW): Reduces financial responsibility for vehicle damage
• Theft Protection: Coverage for vehicle theft
• Personal Accident Insurance: Medical coverage for injuries
• Personal Effects Coverage: Protection for personal belongings

8.2 Deductibles

Standard deductibles apply:

• Economy/Compact vehicles: $1,000
• Mid-size/Full-size vehicles: $2,000
• Luxury vehicles: $5,000
• Exotic/Supercar vehicles: $10,000

8.3 Coverage Exclusions

Insurance does not cover:

• Damage from prohibited use
• Mechanical breakdown due to abuse
• Interior damage from smoking or pets
• Damage to tires, wheels, or glass (separate coverage available)
• Damage while driving under the influence

9. Damage and Loss

9.1 Damage Assessment

You are responsible for all damage to the vehicle during the rental period, including:

• Collision damage
• Vandalism or theft
• Interior damage or excessive wear
• Missing accessories or equipment

9.2 Loss of Use

If the vehicle is damaged and requires repair, you may be charged for loss of use based on our current rental rates for the repair period.

9.3 Administrative Fees

Administrative fees apply for processing damage claims, typically $150-500 depending on the severity and complexity of the claim.

10. Cancellation and Refunds

10.1 Cancellation Policy

• Free Cancellation: Up to 24 hours before pickup
• Late Cancellation: Within 24 hours: 50% of first day's rental
• No-Show: Full first day's rental charged
• Specialty Vehicles: 72-hour cancellation policy

10.2 Refund Processing

Refunds are processed to the original payment method within 5-10 business days after cancellation confirmation.

10.3 Early Returns

No refunds are provided for early returns. The full rental period is charged regardless of actual usage.

11. Extensions and Modifications

11.1 Rental Extensions

Extensions are subject to vehicle availability and must be approved before the original return time. Late return fees apply if extensions are not pre-approved.

11.2 Vehicle Exchanges

Vehicle exchanges may be accommodated subject to availability and may incur additional fees.

12. Customer Obligations

12.1 Driver Responsibilities

• Comply with all traffic laws and regulations
• Maintain the vehicle in good condition
• Report accidents or damage immediately
• Secure the vehicle when unattended
• Follow manufacturer's operating instructions

12.2 Notification Requirements

You must immediately notify us of:

• Any accident or damage
• Vehicle theft or break-in
• Mechanical problems or breakdowns
• Traffic violations or citations
• Any police involvement

13. Force Majeure

We are not liable for failure to perform our obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, labor disputes, or other force majeure events.

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Ontario, Canada, and any disputes will be subject to the exclusive jurisdiction of Ontario courts.

15.2 Mediation

Before pursuing legal action, parties agree to attempt resolution through mediation via a mutually agreed mediator.

15.3 Limitation of Liability

Our liability is limited to the rental charges paid. We are not liable for indirect, consequential, or punitive damages.
